Please Note:
Samples and memorials in our showroom cannot always reflect the exact colour and tone of another memorial in the same granite.
If a specific colour is required, then a visit to our warehouse is recommended to select from existing stock.

STONE COLOURS

​

The memorials we create are fully natural products and like most natural materials, they vary in texture, colour and lustre. Any such variations, can in no way be considered as defects as they are natural characteristics of the stone and gives it its own natural beauty and individuality. 

Due to these variations, we can not guarantee 

Therefore, careful consideration should be given, as to whether the structure, veining and colour variation of the particular granite you've chosen will be acceptable, as it will not be possible to eliminate any of these natural markings after the worktop has been installed. Whilst granite is very hard wearing and stain resistant it is still not perfect due to its natural structure. Such features are an inherent part of the product and will not reduce the quality of the goods. Please remember: Should you have any other concerns regarding the material you have chosen please consult a member of our fully trained staff who will be able to help and advise you before proceeding with your order

MURDOCK MEMORIALS TERMS AND CONDITION OF SALE

The Company Murdock Memorials.

The Customer The person or persons who have requested the order.

The Contract The contract between the Company and the Customer for the sale and purchase of the goods/services incorporating these conditions.

The Goods The products or The Services detailed on the order.

The Price The total of all goods, services and taxes shown on the order form.

1 Basis of Sale
All Contracts between the Company and the Customer shall be subject to these and only these terms and conditions of sale.
No variation, waiver or addition to these conditions shall be binding unless agreed in writing and signed by both the Company and the Customer.


2 Orders and specifications
2.1 It is the Customers responsibility to check that all details on the order are correct. The Customer will sign the order as acknowledgement of its accuracy.

2.2 The illustration provided is for illustration purposes only. The style, colour and dimensions of the Goods, including any related artwork and wording are subject to reasonable variation.
2.3 The Goods supplied are natural materials and are subject to their natural markings, veins, variations in colour, shading, texture fissures and vents. They are fitted with synthetic sealant with reinforced, stainless dowels and may be dressed with resin, silicone and laquered where necessary. Such features should in no way be regarded as defects as they are part of the natural formation and do not reduce the quality of the Goods.
2.4 All samples provided serve only to indicate in a general way the colour, markings and texture found in each particular material. Descriptions and pictures etc, are for general guidance only and do not form part of the Order.
2.5 All thickness measurements quoted are estimates and actual thickness measurements are subject to reasonable variation.
2.6 Goods supplied on Orders subsequent to an original order for the same item may not match the original due to natural variations.
2.7 Goods may change appearance through normal wear and tear, natural maturing or humidity fluctuations.

3 The Price
3.1 The price of the Goods is the price stated in the Order. All Goods and services will be subject to VAT as applicable.
3.2 All prices quoted are valid for ninety days from date of estimate.

4 Terms of Payment

4.1 Unless the customer has a registered account with the company, they will pay for the goods or services as specified below.

For memorials such as headstones, monuments, surrounds or any bespoke goods, a 50% deposit of the purchase price must be made to secure the order before manufacturing. The remaining balance is to be paid within 21 days after completion.

Additional inscriptions, lettering, renovations, repairs, or any 'grave maintenance' services must be paid in full before the work is carried out, unless other arrangements have been agreed upon between the customer and the company.

Sundry items and accessories must be paid in full prior to delivery or installation, or payment in full upon collection.
4.2 If the customer wishes to cancel this order it must be done within three working days from the order date otherwise this deposit is non refundable. This is to cover for the cost of material handling and restocking charges.
4.3 The Customer cannot request cancellation of the Order unless they pay the losses and costs suffered by the Company as a result of cancellation.
4.4 No payment shall be deemed to have been received, until the Company has received cleared funds. The Customer shall not be entitled to withhold payment for any reason.
4.5 The Company reserve the right to charge interest of 1.5% per month on overdue accounts exceeding the agreed payment terms (whether before or after any judgement)
4.6 The Company reserves the right not to deliver the Goods in the event of non payment of the Price. 

4.7 The Company reserves the right to remove any fitted Goods, or collect and hold any supplied Goods in the event of non payment of the total Price.

5 Delivery
5.1 Any dates quoted for delivery of the Goods are estimated dates only.
5.2 Every effort will be made to keep delivery dates but no liability will be accepted for loss through delay for reasons beyond the companies control or, by industrial disputes of any kind.
5.3 It is the Customers responsibility to provide reasonable safe proximate access to the premises for the delivery or installation.

6 Risk and Property
6.1 The Customer is responsible for any loss or damage to the Goods once the Goods have been delivered or installed to the Customer.
6.2 The Company retains the ownership of the Goods until the Company has received full payment of the Price.


7 Warranties and Liabilities
7.1 The company shall be under no liability in respect of any defect in the goods arising from any drawing, design specification or template supplied by or on behalf of the customer.
7.2 Important Notice : Time limit for further notification of claims. The customer will inspect the goods following delivery or installation, and any shortages or damages to the goods or any other claim must be notified to the company in writing within 7 days of delivery or installation, or by e-mail at info@murdockmemorials.com failing which the company shall not be under any obligation to rectify damages unless a time extension is requested by you and agreed by us in writing.
7.3 Where any valid claim in respect of the goods which is based on any defect in the quality or condition of the Goods or their failure to match their description is notified to the company in accordance with these conditions. The company shall be entitled to replace the goods (or the part in question) free of charge or, at the discretion of the company refund the customer the price of the goods (or a proportionate part of the price) but the company shall have no further liability to the customer.
7.4 The companies liability arising from any loss or damage in connection with the manufacture, sale, installation, delivery, or use of any Goods sold by the company shall in all cases be limited to the cost of replacement or repair of the relevant goods and under no circumstances shall the company be liable for any other damage or expense occasioned by any breech of contract, negligence, or breech of duty whatsoever and whosoever.

7.5 The customer shall be solely responsible for contacting and informing any additional parties that may have any issues/disputes regarding the Goods or Services provided. In the event of a dispute between related parties regarding the Goods or Services provided, the main customer will be responsible for all costs incurred in resolving the dispute, including but not limited to, legal fees and any additional service charges or damages. The main customer will also be responsible for making any necessary changes to the grave site, as requested by all parties involved in the dispute. If the main customer is unwilling or unable to pay for these costs, we reserve the right to discontinue services to that customer.
